Signature of a Collaboration Agreement between the General Directorate of Customs of Côte d'Ivoire and UNIWAX SA

Since its creation in 1968, UNIWAX has adopted the best technical processes and constantly evolving know-how for the development of its patterns and the manufacture of its products, guaranteeing its professionalism and the high quality of its products. Over the years, Uniwax African fabric have acquired a great reputation among the various populations in Côte d'Ivoire and throughout Africa.

The global and widespread phenomenon of counterfeiting that has been rampant in recent years is growing and hurting private sector companies, undermining their competitiveness and threatening many local jobs. The State is also affected by this phenomenon, as it is consequently deprived of substantial tax revenues.

Uniwax has therefore decided to fight mercilessly against counterfeiters and distributors of textile products reproducing its patterns and brand, in order to guarantee original quality to its customers.

This is why all patterns and designs used by UNIWAX are legally registered with the African Intellectual Property Organization (OAPI) in charge of protecting intellectual property rights.

Moreover, reflection forums and concerted actions between companies and the Government have resulted in bills, counterfeit product seizure operations and publicized incineration of counterfeit goods.

Despite all these efforts made by the State of Côte d'Ivoire through the Customs services, and those of the Ivorian National Police, our markets are still flooded with counterfeit products from various countries, particularly those of Asia, thus destroying the local economy.

That is why, today more than ever, at the level of Côte d'Ivoire, the authorities have made the fight against counterfeiting and fraud a priority for government action, which is reflected in the establishment of a Sub-Directorate for the Fight against Counterfeiting.

This commendable initiative requires close collaboration between the private and public sectors, which we want to express in this collaboration agreement and whose main terms are as follows : capacity building and coordination of actions so as to facilitate the fight against counterfeiting on the territory and at borders.

The signature of this agreement will therefore formalize the reciprocal commitments which the signatory parties have freely agreed to enter into.

Let us recall that counterfeiting is the act by which a natural person or body corporate uses or exploits an intellectual property right without the prior authorization of the owner or his assigns.

Counterfeiting of trademarks, patterns and designs and unfair competition are offences punishable by severe penalties of imprisonment or fines (3 months to 2 years' imprisonment and a fine of CFAF 1 000 000 to 6 000 000) and also subject offenders to additional measures such as professional prohibition (Article 84 Criminal Code), facility closure (Article 85 Criminal Code), forfeiture and destruction of counterfeit products, all this without prejudice to compensation for damage.

It should be noted that the law gives the same treatment to counterfeiters as to sellers who knowingly distribute counterfeit products.
